In preparing this estimate no increase has been calculated for, in the production of the rates and assessments of 1842 over those of 1841, although a gradually progressing improvement it is presum- ed must follow each succeeding year. The Freehold Estate of the District consists of the following items, which have been valued as follows, viz : — A Town Lot sold to Mr. Berezy, on f* which a balance is payable with , interest in a series of years, - 262 10 The lot sold to the Trustees of St. Andrew's Church, £450, with 11} years interest, 310 10, as stated by the Treasurer, - - - 760 10 Six Lots on Newgate Street, - 1500 Four do. on Church Street, - 1400 Four do. on Toronto Street, - 1000 The old Gaol and Court House, - 3000 Total, £7923 Besides the new Gaol which has cost upwards of 16000/. Against all or the greater part of the above Freehold estate, valued at 7,923/., the Bank of Upper Canada holds a Mortgage for 7,000/. In reference to the large amount of 760/. lOs. claimed to be due from the Trustees of Saint Andrew's Church, the Committee recommend that the said Trustees be applied to and requested to institute an amicable suit in Chancery in order to the adjustment of the terms upon which a Deed shall be directed to be made to them from the Trustees of the Gaol and Court House block, for the ground upon which that edifice stands, and that in the event of their declining to pursue that course, the Sheriff of the Dist^-ict be directed to execute the writ of ejectment now in his hands as the only course left for the Council to pursue un- der the circumstances. There is a claim in suit in the Court of Queen's Bench on the part of the District, vs. Osborne, for damage done to the Court House by excavating below the foundation of said Court House. Whetlier the Council will direct the Treasurer to liquidate so much of the debt due to the Bank of Upper Canada by the immediate payment of 1000/. out of the balance of 1072/ 13s 6d above stated, and of other 500/. out of the proceeds of the Debenture due on the 1st July next, or reserve the same for other appropriation to district pur- poses, remains for its consideration. The Committee recommend that the Council as- sume the property, debts, and liabilities of the dis- trict, as the same stood on the 1st January, 1842. The Committee further recommend that the Council do now order that the Treasurer do pay over in liquidation of such Debentures as the Bank of Upper Canada hold against the District as soon as the sums, or a part thereof, of 1000/. and 500/. shall come into his hands. The Committee recommend that the Warden direct the District Surveyor to take charge of all property belonging to the district under the statute. All which is respectfully submitted. J.
