That all plumbers' work connecting the London Waterworks system with or contained in any lands, premi.ses, house, store, office, building or part of building, .shall be done in a good and workmanlike manner with first-class materials, sufficiently strong to resist the pressure of the London Water- works system and the water contained therein, and all hose, jets, cocks and other appliances, used for the purpose of draw- ing off the water, shall be subject to the approval of the said Commissioners or their duly authorized agents or ofificers ; and should any such work or materials not be approved by the said Commissioners or their duly authorized officers or agents, or become out of repair, it shall be lawful for the said Com- missioners to turn off or refu.se to turn on the supply of water ; and no person shall be allowed to make any connection with the said London W'aterworks for any purpose whatever, unles;; he or they shall have first received permission in writing, from the Secretary, to make such connection on each and ever)- .se[)arate occasion. The Secretary may have the water shut off the premi.ses of any [)erson or persons infringing any of the rules and regulations made by the sa'd Commissioners, and in cases where the water has been shut off for allowing wftste or leaks or defects in pipes or cocks he shall refuse to turn it on again until he shall receive satisfactory evidence that the necessary repairs have been properly made, and pay- ment of the sum of One Dollar. 17. That all persons taking water shall keep their own service pipe, and all fixtures connected therewith, well pro- tected from frost, at their own expense, and also shall keep in good repair, or replace by a new one when necessary, the com- pression cock placed at the termination of the service pipe by the said Commissioners. 18. All persons having fixtures and attachments for fountain, ho.se and lawn sprinklers, will be held chargeable for the rate therefore, whether the same be actually used or not, .subject however to the following section. 19. The right is hereby reserved to suspend or stop the supply of water by the resolution of the Water Commissioners for the City of London, to all consumers for use in fountains or by jets, garden hose or sprinklers, or to further limit the hours for using the .same, whenever in the discretion of the .said Commissioners the public interests may require it. iiyilii,/services. -O. That it shall be lawful for the said Commissionersi whenever they shall deem it advisable, to compel the use of water meters by any consumer or consumers, and to refuse to supply water to any premises whatsoever unless the person or persons requiring the water shall sign an agreement to take, use and pay for such water, according to the rates provided for that purpose ; every owner, tenant or occupant, .shall give every facility for the introduction of water meters, and shall protect the same from frost (jr other damages, when placed Riyht to suspend supply for fountains, eti;. Meiers plai .'(I. 1 i;. upon their premises by the said Cominissioncrs ; that when- ever any person or persons refuse or neglect to pay water rates or rents within the time specified in the said agreement for the water as registered by the water meter it shall and may be lawful for the said Commissioners to cut oft" the supply, and also in ever)' such case to collect the water rates or rents, for the water supplied as if no water meter had been used ; and in all cases where the water meter indicates that no water has been used it shall and may be lawful to collect the same water rates as if no water meter had been introduced. No extension of main shall be made unless the revenue to be derived from consumers on such extension shall amount to ten per cent, of the cost of such extension ; unless it appears to the Commissioners that some special circum- stances exist which render it advisable to make the Sr\me. 23. Parties signing petitions for extensions of mains shall agree to become consumers of water, and when such mains are extended may be compelled to pay the usual rates for water, whether they become consumers or not. 24. That all persons having motors in their dwellings, using city water for pumping water from wells or cisterns, shall place the motor in such a manner that all city water used in such dwellings shall pass through the motor. The position of all motors shall be subject to the approval of the Engineer and Inspector. 25. The hours of labor, and the scale of wages, of work- men in the Waterworks Department shall be the same as provided for in the Standard Wages liy-Law adopted by the Council of the City of London. In all contracts for the performance of work for the Water- works Department, a provision shall be inserted requiring the contractor, as far as practicable, to employ workmen who have resided in tlie City of London for at least three months, and that the hours of labor, and scale of wages on such work, shall be the standard provided for in the Standard Wages By-Law adopted b)* the Council of the City of London. 26. No person or persons shall lend, .sell, give or other- wi.sc dispose of, the water supplied by the said Commissioners, or permit the water to be carried or taken away for the use or benefit of others, or increase the supply agreed for with the said Commissioners, or wrongfully or improperly waste the water. 2i>. That any person or persons injuring or destroying an>' turncock, hydrant, or any other property belonging to the Corporation of the City of London, or the Water Commis- sioners for the City of London, or who shall be guilty of infring- ing any of the provisions of this By-Law, shall, on conviction thereof before the authorities, forfeit and pay a sum not ex- ceeding twenty dollars, one half of which fine shall be applied for Waterworks purpo.ses, and the other half be paid to the person who laid the information, unless the punishment for such infraction is provided by Act of Legislature. 29. In default of payment of any fine imposed for the infraction of any of the provisions of this By-Law, it shall and may be lawful for the Police Magistrate or Justice convicting to issue his warrants to levy thd amount of fine on the goods and chattels of the offender ; and in case no sufficient distress be found to satisfy such fine, it shall and may be lawful for the Police Magistrate or convicting Justice to commit the offender to the common jail, with or without hard labor, for a period not exceeding one calendar month. 30. That all By-Laws heretofore passed by the Water Commissioners for the City of London which conflict in any way or manner with the provisions of this By-Law are hereby repealed. The hours for the use of water from the London Water- works by consumers in fountains, or upon lawns, yards or grou'iOs, be and they are hereby limited to Mondays, Wednesdays and Fridays between the hours of Six and Eight A. M., and Tt'esdays, Tliursdays and Saturdays between the hours of Six and Eight 1'. M. 2. No person shall, except during the hours provided for in the next preceding paragraph hereof, use water from the London Waterworks in any fountain, or ui)on any lawns, yards or grounds. 3. In case of leaky or improper pipes or fixtures on any premises the Secretary of the Water Commissioners for the City of London shall have authority to cut off the supply of water by shutting the stop-cock or detaching the service pipe from the main, and before the water is again turned on the [)ipes and fixtures shall be repaired or altered, as re(|uired by the Water Commissioners for the City of London, and the cost of detaching and re-attaching, or of turning off and on the water, which is hereby fixed at not less than One Dollar, shall t)e paid by the person occupying or owning the premises, and no person supplied from such service pipe shall have any claim against the said Commissioners by reason of such cutting off of the water. 4. No person shall sprinkle any public or other street with water supplied from the London Waterworks. Nothing herein contained siiall apply to the Street Watering Contractors, or the Corporation of the City of London, or to the watering of boulevards. 5. Any person guilty of an infraction of the provisions of Sections Two or Four of this By-law shall, upon conviction, forfeit and pay a penalty not exceeding the sum of Twenty Dollars for Waterworks purposes, for each offence, or shall be imprisoned in the Common (ioal of the County of Middlesex for a period not exceeding one calendar month, the amount of such fine, and dura- tion of such imprisonment, and also the option between imprison- ment with or without hard labor, being always in the discretion of the Magis:rate before whom any proceedings may be taken for enforcement thereof. If any person shall wilfully or maliciously hinder ori"J"o>': interrupt, or cause or procure to be hindered or interrupted, the said C'ommissioncrs,or their manatjjcrs,contractors,servnnts, agents, workmen, or any of them, in the exercise of any of the powers and authorities in this Act authorized and contained ; or if any person shall wilfull>- or maliciously let off or dis- charge any water so that the same shall run waste or useless out of the said works ; or if any person shall throw or deposit any injurious, noisome, or offensive matter into the said water or Waterworks, or upon the ice, or in any way foul the same, or commit any wilful damage or injury to the works, pipes or water, or encourage the same to be done, every person offend- ing in any of the cases aforesaid shall, on coviction thereof before any Justice of the I^eace having jurisdiction within the locality where the offence shall be committed, forfeit and pay for every such ofTence a sum not exceeding twenty dollars, ^'""''y- together with the costs of conviction : one half to be applied to the use of the C'omjnissioncrs for Waterworks purposes, and the other half to him or her who shall lay the information ; and in case the parties suing for the same shall be the Com- missioners themselves, or any of their servants, officers, agents, or workmen, then the whole of the said penalty shall be applied to the use of the Commissioners for Waterworks pur- poses ; and such Justice may also, in his discretion, further condemn such person to be confined in the common jail of the County of Middlesex, for any period not exceeding one calendar month, as to such Justice shall seem meet ; and any such person or nersons so offending shall be liable to any i6 k water. action at law at the suit of the Commissioners to make good any damage done by him, her, or them. iw.ti.m.f |~_ The Commissioners and their tjfticers shall have the othirers III t:\«r- |.. ... • i- i • • /v ■ tiseofiheiriiuty. like protection in the e.xercise of their respective ornces and the execution of their duties as Justices of the Peace now have under the laws of this Province. ing"off w»te^!^"" '^- '<^ an>' person or persons shall la>- or cause to be laid any pipe or main to communicate with an>- pipe or main of the said Waterworks, or in any way obtain or use any water thereof without the consent of the Commi.ssioners, he or they shall forfeit and pay to the Commissioners, for Waterworks l)urposes, the sum of fifty dollars, and also a further sum of five dollars for each day or part of da)', or night or part of night, such pipe or main shall so remain ; which said sums, together with costs of suit in that behalf, ma)* be recovered by civil action in any court of law in the Province having civil jurisdiction to that amount. It shall be lawful for the officers of the Water Com- P^S^.TJ^'iy;','; missioners, and every person authorized by them for that purpose, to have free access at proper hours of the day, and upon reasonable notice given and request made for that pur- pose, to all parts of eveiy building in which water is delivered and consumed. 32.
