[Passed ISth March, 1865.] An Act to Incorporate the Montreal Homoeopathic Association. » WIIERKAS certain individuals, residents of Montreal have by their i)etition praycnl to bo incorporated as a Homoeopathic Association, to enable thcni to establish a dispensary, an hospital, and for other purposes ; Therefore, Her Majesty, by and with th" advice and consent of the Legislative Council and Assembly of Canada, enacts as follows : 1. James A. Mathewson, James Baylis, G. A, Holland, James Muir, Thomas Mcdinn, John AVanless, M.D., and F. E. Grafton and all other persons who may join or replace them tor the purposes of this Act, are hereby constituted a body politic and corporate, by the name of " The Montreal Homceopathic Association." 2. The said Association shall liave power to establish in the City of Montreal, a Dis])ensary, to give medical advice, medicine and surgical aid to the necessitous poor, in accordance with the principles and practice of Homcieopathy. li. The said Corporation shall also have i)ower to establish and irtaintain, whenever the Association shall so decide, a Homoeopathic IFospital in the City of Montreal, for the reception of persons needing medical or surgical treatment. 4. The said Corporation shall also havo power to establish a College, and aj)point jyrotessors to teach, by regular courses of lectures, the princijJes and practice of medicine and the materia medica, according to the doctrines of Homoceopathy, to such persons as have received or are receiving instruction in all the other requisite branches of a medical education. All such professors must be medical graduates of a liritish or Provincial University, or medical licentiates of a British or Provincial College or Board legally in- corporated. The said College shall be known as the Homeopathic College of Montreal. mia ■MtU iiiri— !'■ 5* The said College may at any time become affiliated to any Provincial University between which and the said College mutually satisfactory tenns may be agreed upon. 6. The said Corporation shall have power to appoint throe persons who shall bo medical graduates of a British or Provinoial University, or medical licentiates of a British or Provincial College or Board legally incorporated, to bo a Board of Kxaminors to cxaniino all persons who may desire to obtain a license to practice medicine according to the doctrines and teachings of Homa'opathy within the Province of Lower Canada. 7« Every person who desires to be examined by the said Board, touching his qualifications to practice physic, surgery and midwifery, or either of them, according to the doctrines and teacliings of Homoeopathy, shall give at least one month's notice in writing to the Secretary of the Association ; and must show tliat ho is not less than twenty-one yoai-s of age, that ho has followed medical study for not less than four years, under the care of one or more duly quali- fied medical practitioners, and that he has attended at some university or incorporated school of medicine not less than two six months' courses of anatomy, physiology, surgery, theory and practice of medicine, chemistry, materia medica and thei'apeutics, respectively ; and not less than one six months' course of Clinical Medicine, and Medical Jurisprudence, respectively, and shall have passed the examination required })y such University or incorporated school of medicine as a])propriate to such courses. 8. If the Board be satisfied by such examination, that the pei*son is duly qualified to practice either or all the said branches of medicine, as they are undei-stood and pvacticed by honuvpathists, they shall certify the same under the hands and seals of two or all of such Board. 9, The Governor, on the receipt of such certificate, may, if satisfied of the loyalty, integi-ity, and good morals of the ap])licant, grant to him a license to practise physic, surgery and midwifery, or either of them, in Lower Canada, conformably to the certificate, and all such licentiates shall be entitled to all the privileges enjoyed by licentiates of medicine under the laws in force in this Province. 10. The said Corporation may acquire by any legal title, and may hold any real estate required for its actual use and occupation, and may at any time dispose thereof and acquire other instead thereof. The said Corporation may receive donations or bequests of real estate, on condition that all not required for actual occupancy shall hv sold within seven years after it shall have come into the possession of the Corpomtion ; Provided, that the whole real pro- perty of the said Corporation sliall not at any time exceed in annual value five thousand dollars. 11. No bequest in favor of the said Corporation shall be valid, unless made at least six months before the death of the person making the .same. 13. The said Corporation shall have power to administer their affairs by such and so many directors and officers, and under such restrictions as may Ik- from time to time ordained by by-law, and they may assign to any such officers such remuneration as thej^ may deem just and requisite, and they may from time to time, by a majority of votes at any duly called meeting, establish and put into operation such by-laws, ordinary rules and regulations (the same not being contrary to this Act, or to the laws in force in this Province) as may appear to them necessary or expedient, and may from time to time amend or repeal the same ; but no by-law or alteration shall ever be made tending to alter the character of the Association as a Homoeopathic Institution. V^ 13. The said Corporation shall at all times, when thereunto re- quired by the Governor, or either House of the Legislature, make a full return of their property, real and personal, and of their receipts and expenditures, for such period, and with such details and other information as the Governor or either House of the Legislature may require. 14. The (.'or]»oration shall ai)point a registrar, and shall cause to he kept hy him the register in which shall bo entered from time to time, {]) names of all persons who shall have been didy licensed under the Act 28 Vict., cap. 51), or the Acts amending the same, and who shall have comi)lied with the said Acts and the regulations made anathy ;and those persons only whose names are or sliall hereafter he inscribod in the register above mentioned shall be deemed to be qualified and licensed to [traetice medicine, surgery and midwifery, according to the doc- trines and teaching of Jioma'oi)athy, in the Province of Quebec. And such register shall at all times be open and subject to inspec- tion by any duly registered practitioner in the Province, or by any other person. 4. It shall be the duty of the Registrar to keep the register cor- rectly, in accordance with the provisions of this Act and the orders and regulations of the said Cori)oration or the said College, and he shall from time to time make the necessary alterations in the addresses or qualifications of the persons registered under this Act, and the said Registrar shall perform such other dutieu as shall be imposed upon him by the said Corporation or the said College. 5* Any person not entitled to be registered in the Province, who shall be convicted, upon the oath of one or more witnesses, of having practised medicine, surgery or midwifery, according to the doctrines and teachings of Homo3opathy, in the Province of Quebec, in contravention of the provisions of this Act, afler the passing of this Act, for hire, money, goods or eflects generally, whatsoever, or in the hope of receiving any money, goods, or eilects, or in the hope of a reward (or who shall receive any reward whatsoever), shall for practising medicine, surgery, or midwifery, according to the doctrines and teachings of Homa»opathy, incur \ penalty of fifty dollars ; 2. A like penalty of fifty dollai-s shall be incuned by every person aesuniing, after the passing of this Act, the title of doctor, physician I I or surgeon, or any other nf\me, implying that he or she is legally authorized to practise medicine, surgery or midwifery, according to the doctrines and toaching of Homa^opathy, in this Province, if unable to oata])li8h tlio fact, by log-al proof, as re({uirod by the present Act and the laws of the country : 3. The penalties iuiposed by this Act may be recovered by an ordinaiy civil suit, in the name of the Montreal llomteoi)athic Association, before any Circuit Court of the County or of the District in which the defendant is domiciled, or in which the oHence was comitted ; and the Court, if the proof is sufhcient, ni ly con- demn the defendant to ])ay a ])enalty of tifty dollars, in addition to the costs, within a delay which it sliall determine, and to an imi)ri- sonment of sixty days in the common gaol of the district in default of his paying the amount of the judgement within such delay. The warrant of imprisonment, in su(;h case, shall issue under the hand of the clerk uf the said Court, on a written application of the attorney ad litem of tlu^ prosecution, and may, vutfafiff mutandis be according to form (Oi), in the schedule to the Federal Act, 32-33 Victoria, Cha])ter 31, and shall be executed in the usual way. 6.
