Be it there/ore enacted, by the Council of the Municipal Corporation of the Township of Raleigh, in Council asssembled vnder and iy virtue of an Act 29 and 30, Vic, cap. 61, of the Annual Statutes of Upper Canada. I. That for and notwithstanding anything contained in By-law num- bered thirteen of the By-laws consolidated and ptiblished in the year 1865, the portions of the Township of Raleigh heretofore known as lying in the County Statute Labor Division, and not belonging to any Division in said recited By-law, be, and the same is hereby attached to the Divisions to which the lands adjoin ; and the Statute Labor shall belong to and be laid out under the directions of the Overseers of the respective Divisions to which the lands are attached. Whereas it is necessary that the Municipal Officers appointed by this Corporation in each year, should be appointed under the seal thereof: Be it therefore enacted by the Municipal Corporation of the Township of Raleigh, in Council assembled, under and by virtue of an Act 29th and 30tb Vic, cap. 51, of the Annual Statutes of Upper Canada : I. That A. D. Lewis, nominated by the Reeve, and George Coutts, nomi- nated by the Council, are hereby confirmed in the office of Auditor, and that their salary shall be the sum of $6 each, and no more. IL That Robert Slade is hereby confirmed in the office of Assessor, and it shall be his duty to complete and return his Roll to the Cleric not later than the Fifteenth day of April next, and that his salary shall be the sum of $60, and no more. III. That Martin Dillon is hereby confirmed in the office of Collector, and he is hereby required to enter into bonds on or before the meeting of this Council in the month of May, himself in the sum of $4,000 and other good freehold securities to the amount of $8,000 ; which bonds shall require him to collect all rates levied on the Collector's Roll, and to pay over the same to the Treasurer of this Corporation in manner following, that is to say :— On his receiving the Collector's Roll he shall commence to collect the rates, and shall pay in all money received by him for taxes at least every two weeks, and shall finally collect and make the return to tlie said Treasurer, as required by law. Salary, $60, and no more, except what is allowed for School per centage. And it shall be the duty of the Collector, on settling with the Treasurer, to make a report of all the taxes he has received in Bank notes or other current funds, and to pay over the same, under a penalty of the forfeiture of hip salary. XVIII. That every tavern, inn, and hotel, in which spirituoni or fer- mented liquors or drinks are ordinarily sold, shall be closed during the days appointed for polling in the electlDns of Members of Parliament, in the same manner aa it should be on Sunday ; and no spirituous or fermented liquor^t or drink shall be sold or given during said period, under a penalty of one hundred dollars against the keeper tliereof if he neglects to close it; and under a like penalty if he sells or gives any spirituous or fermented liquors or drinks aforesaid. XIX. That any person guilty of xn infraction of any of the provisions ot this By-law shall, upon conviction thereof before the Reeve or any other Justice of the Peace having jurisdiction within the Municipality, when any one such person can act, or before any two of them when two of them should act, forfeit and pay, at the discretion of the convicting Justice or Justices, when no specified penalty is hereinbefore mentioned, the sum of $5 for the Qrst offence ; $20 for the second offence ; and $50 for the third attd each subse- quent offence; and in deiauit of the payment of any hne imposed under this By-law, together with the costs uf prosecution, it shall be lawful for the convicting Justice or Justices to levy the same by distress and sale of the goods and chattels of the offender ; and in case no s ifficient distress can be found to satisfy the said fine and costs, it shall be lawful for the convicting Justice or Justices to commit the offender to the common gaol of the County of Kent for a period not to exceed thirty days. XX. That all penalties imposed for the infraction of any of the provisions of this By-law (except where otherwise provided) when collected, shall be paid, one-half to the informer, and the other half to the Township "Treasurer, for the general purposes ot the "rownship. DUTIES OF THE INSPBGTOB. It shall be the duty of the Inspector of Shop and Tavern Licenses, Ist. To take the Declaration and Qualification of Office required by law, and to enter into Bonds, to be taken by the Clerk, in the sum of Two Hun- dred Dollars, with one good surety in the sura of One Hundred Dollars, conditioned for the efficient discharge of his office. 2d. He shall, in the month of February in each year, visit the premises of all applicants whose applicatious have been sanctioned by the Council of the Municipality, at a meeting held for that purpose on the second Monday in February of each year, and after carefully examining said premises, shall, on finding the necessary accommodations, grant a Certificate addressed to the Clerk to that effect. Also, aftor visiting the premises of all applicants, shall send a report on the state of said premises to the Council, stating to whom he has granted Certificates, and to whom he has not, with the reason therefor, and any information or suggestions that may be useful for regulat- ing the sale by retail of Intoxicating Liquors. 3. It shall be the duty of the Inspector, on receiving notice from any member of tho Council, or other person, or on his being aware that any person or persons are selling liquor without License, or guilty of keeping a disorderly house, if he deems the evidence sufficient, be shall promptly make a complaint to the Reeve or some Justice of the Peace in the Municipality; or, if he deems evidence not sufficient, he shall fortwith visit the premises of the party or parties complained of, and, on his finding that they are selling intoxicating liquors without a License, or guilty of the violation ot sections five and sixteen of this By-law, he shall then forthwith complain as above, which complaint may be made in the name of the Corporation of Raleigh— in which case the whole of the penalty shall go to the Treasurer of the Mu- nicipality. ]ii \ r itb. And such permission shall authorize the holder thereof to sell such I^iquort in the house mentioned in the endorsement, during the unexpired portion of the term for which the License was granted, and upon the same terms and conditions. And any Bond or security which such holder may have given for any purpose relative to such License, shall apply to the house or place to which such removal is authorized. 6th. Any person interfering with the Inspector in the discharge of the duties of his office, shall, on conviction theioof, be liable to a penalty of Ten Dollars, with costs. 0tb. On the Inspector refusing or neglecting to fulfill the duties as re- quired qj this By-law, or who issues a Certificate contrary to the provisions of this By-law, shall be deemed guilty of a misdemeanor, and upon convic- tion thereof shall for each offence pay a fine of not less than Forty Dollars nor more than One Hundred Dollars ; or he may be imprisoned for a period not exceeding thirty days; or, in the discretion of the Court, may l)e both fioed and imprisoned. VIOTUALLING UOUSKB. Any person being desirous of keeping a Victualling House, it shall be the duty of the Inspector to visit such house, to ascertain if such person has the necessary accommodations, wbioh shall be the same as those required for a Tavern ; if he finds such party duly qualified, and having the requisite ac^ commodations, he shall grant a Certificate, and on said Certificate, together with the Treasurer's receipt that the sum of Five Dollars has been paid, the Clerk shall grant a License, receiving from the Licensee the sum of One Dollar. And any person opening su^ a house without first obtaining a License, shall be liable to a penalty of Ten Dollars, recoverable in the usual manner before a Justice or Justices of the Peace. Whirbas, the Clerk has made and submitted a statement to this Gounoil of the amount available to each Rural Boad Division for the improvement of the Road and Bridges, according to a By-law regulating the apportion* ment of the money derived from non-resident lands and statute labor. Se it therefore enacted by the Municipal Council of the Township of Raleigh assMnbled, under and by virtue of an act, cap. 51, of the annual statutes of 1866. I.
