by the Respondent, a BlaclvHinilh, agahist the \|)|)elliints, Joiners, on the yjd ofFeb-

" Three months after date, (we jointly and severally) promise to pay Mr, Robert
Mason the sum of fifty pounds, Halilax currency, for value received.

And so set forth in the Respondent's declaration, followed by an averme- , that, " in-as-much
as the Appellants were immeiiiately to depart the Province, an action had accrued to him,
the Respondent, to have and demand the amount of the said promissory note." By the SherifTs
return to the writ, he certifies that he had taken Far(iuhar McRae, otieof the Defendants, who
had given bail, and wow eM imriilus with respect to Robert Kerr. To this demand Faiquhar
McKae i)leads nil (fcbel am] nan assionpsit ,- and further, that if at any lime he McRae or Ro-
bert Kerr or either ever made the I'loinissory note (which he wholly .leiiies to be true) he al-
ledgos that at the time of suing out the Writ and I'rocess, to wit, on the said 3Jd of February
last, the period for the payment of the said i?50 had not arrived or bfccme due, nor had the

lows : "in Febr-ary last, the Defendant mcMlie Plaintilf and they entered into conversation

" been informed that Kerr had absconded the night preceding, and that lie also heard that
" McRae, the other Defendant, was preparing to follow— and that he had received the iiifbrma-

would appear that the Court below condemned the said McRae to pay the said i'50, with
interest, to be calculated from 2.5th February, date after service of piocess. Noiwithsta'ndina:

the Bespondei.t, or in the evidence adduced, that the Appellants or eitlu-r of them, had any
intention of departing the Province, so as to entitle the Respondent to maiMiain his action.
