I ADDIE, J. STATUTES, RULES AND OSDINANCES. I.-OF THE CORPORATION GENERALLY. 1. Tho Bishops have jointly tho power of appointinf? persons from time to time, as they »hull see fit, to bo incmbors of the Board of Trnstecs, and of tho College Council ; and any five of the memuors of the Corporation shall form a quorum; Provided that both tho Boards of tho Trustees and College Council shall always have a re^^ jsentativo prcnent. 2. The Bishops jointly shall have the power of dismissing any Trustee or mc > or of the College Council, on a representation and request to that effect from a majority of the members of the Corporation at any meeting specially called for that • ■,•.!(•( ^e. 3. The Senior Bishop of the Dioceses of tho Unite 1 Church of England and Ireland, in the Province of Lower Canada, for the time being, shall be President of the Corporation, and the other Bishop or Bishops, Vice Presidents, 4. The President shall preside at all meetings of the Corpora- tion, and in his absence, the Senior Vice President. If neither President nor Vice President be present, a Chairman shall be chosen by the meeting. 5. The Corporation shall meet at Bishop's College annually, on such day, immediately before or after the commpncement of the long vacation, as the President, or in his absence from the Pro- vince the Senior Vice President, shall appoint. The Senior Vice President shall also, in such absence, exercise all the powers and privileges of the President. 6. Special meetings shall be held at other times as the President shall judge accessary ; or upon the requisition of any three mem- bers of tho Corporation ; — such meetings to be held at such time and place as the President shall appoint. And notice of all meetings shall be given in writing to each member, at least one week before the time appointed for holding such meeting, of the V ' 8 specific object or objects thereof j but no alteration or amendment of the original and fundamental regulations of the Corporation shall be made at any meeting of the Corporation, unless notice of such alteration or amendment shall have been given in writing to each member of the Corporation at least one month previously to such meeting. 7. All questions at such meetings shall be determined by a majority of votes of those present, including that of the Pre- sident. 8. There shall be a Standing Committee of the Corporation, consisting of the Chairman of the Board of Trustees, the Princi- pal of the College, the Bursar, rnd the Kegistrar, whose offices are hereinafter provided for, whose duty it shall be to meet at such amc and place, as they shall see fit, to prepare and digest business for the Corporation at its meetings. Nevertheless it shall be in the power of any mf mber of the Corporation in his place, to pro- pose such measures as he shall deem expedient. 9. The Seal of the Corporation, which shall also be the Seal of the University, shall be kept by the Kegistrar. II.— OF THE TRUSTEES. 1. The Trustees shall have the direct disposal and manage- mea , of the funds of the College, of the buildings, and of all other property belonging to it, whether fixed or moveable ; and the Pre- sident of the Corporation, or his Attorney duly appointed to that effect under his hand, shall have power to execute, by affixing the College Seal to any instrument whatever^ by which any property shall be alienated, or acquired. 2. The Trustees shall hold such meetings as shall be found ne- cessary, at the call of their Chairman (to be elected by themselves,) or at the requisition of any two Trustees j with power to adjourn as they please. They shall also have power to appoint out of their own number, if they see fit, a Standing Committee for the trans- action of ordinary business ; which business shall be defined at a meeting of Trustees called for that purpose. Notice of all general meetings sliall be given in writing to each member, at least three days beforehand, by the Chaii-man, or, in his absence, by any two 9 Trastees. At all meetings hereby authorised or required, three Trustees shall form a quorum. 3. All proceedings of the Trustees shall be communicated to the Corporation at its meetings. III.— OF THE COLLEGE COUNCIL. 1. The College Council consists of the persons now appointed or who shall be hereafter appointed thereto, by the Bishops jointly. 2. The Principal of the College, and in his absence the Vice Principal, being Members of the College Council, or in their ab- sence, tlic next Senior Member of the Council, shall preside at all meetings of the same. 3. The Council shall assemble four times in each year, at the call of the Chairman after seven days notice, (thi-ee to form a quorum) at the College, to advise and deliberate upon such matters as may be submitted to them by the Principal, or any other member of the Council. 4. The Council shall have power at any such meeting to make and establish rules, orders and regulations not contrary to the By-laws and Kegulations of the Corporation, for the better gov- ernment of the affairs of the College, whether relating to morals, learning, the good government or the economy of the house. 5. All Rules, Orders, and Regulations made by the College Council, sball bo communicatfid and submitted to the Corporation at their Meetings ; who may amend, alter, or confirm the same. IV.— OF THE VISITORS. 1. The President and Vice Presidents of the Corporation, acting jointly or singly, are Visitors of the College, with power to inspect, from time to time, the state of the College, its concerns, management and proceedings ; — to adjust disputes — to direct and enforce the reformation of any irregularity, neglect, or abuse j and for this purpose to call before him or them any Officer, resident Graduate, Student, or Servant of the College,— if need be, acting jointly, to remove or suspend any such Offioev resident Graduate, Student, or Servant, for misconduct or incompetency, — and to ![l 10 make such further provisions or regulations as may seem to him or them expedient ; — Provided always, that such Provisions and Regulations be not contrary to the principles on which the Col- lege is founded, that they be approved and signed by a majority of the Visitors, and that they be laid before the Corporation at their next ensuing meeting and be subject to their approval ; but such Provisions and Regulations shall have force and effect until altered or annulled by the Corporation, 2. The President of the Corporation, as Senior Visitor, shall interpret the Statutes in doubtful cases. V.—OF THE PRINCIPAL, VICE PRINCIPAL, AND OFFICERS OF THE COLLEGE. 1. The Principal, Vice Principal, Professors, and Bursar, shall be Communicants of the Church of England, and shall, before entering upon the duties of their respective appointments, take the oath of allegiance, and make oath befo. a Judge of any Su- perior Court of original jurisdiction in civil matters, or any Circuit or District Judge, or any othe rperson duly authorized to adminis- ter oaths of office, faithfully to execute their several offices ; and shall subscribe the thirty-nine articles of Religion and three arti- cles of the thirty-sixth Canon. 2. The salaries, fees, and emoluments of the Principal, Profes- sors, and Officers, of the College shall be paid by the Corporation. 2. The Principal of the College shall be a Clergyman in full orders of the Church of England, and a graduate of some Uni- versity of repute in the British dominions, and shall be appointed by the Visitors jointly from time to time. 4. There shall be a Vice Principal, who shall be appointed by the same authority. 5. The Principal shall reside in or near the College. He shall be the chief Executive Officer of the College Council, and shall be charged with the internal government of the College, have autho- rity to appoint and remove subordinate officers and servants, and it shall be his duty to enter Students of the College, to take care that the Statutes, Rules and Regulations of the College be faithfully observed, to enforce discipline, and to preside over College exercises. 11 6. The Principal shall have the power of reprimanding publicly, and if need be, of rusticating or expelling any Student guilty of misconduct, provided that sentence of expulsion be not carried into effect until confirmed by the President of the Corporation. 7. In the absence of the Principal and Vice Principal, or during the vacancy of the office, the Senior Officer of the College shall have the powers, and perform the duties of Principal. 8. The Professor of Divinity shall be appointed by the Visitors jointly, and shall be a Clergyman in full Orders of the Church of England, and a graduate of some University of repute in the British dominions. 9. All other Professors shall be appointed by the Corporation. It shall be their duty to carry on the course of instruction pre- scribed by the College Council and according to its ilirections in both departments of the College ; and all Professors shall be re- quired to deliver at least one written lecture in each term, on some subject connected with their several departments, and open to all the members of the College. 10. The Rector of the Junior Department, hereinafter provi- ded for, shall be a Professor of the College, and shall be appointed in the same manner as the other Professors. 11. Tutors to assist the Professors may hereafter, as occasion shall arise, be appointed by the College Council by whom their duties shall be prescribed. Their appointment, however, shall be subject to the approval, and their salaries shall be provided for from the revenues of the Corporation. 12. Lecturers and Teachers in particular branches of education may from time to time as opportunity shall offer, be appointed by the College Council, by whom also their duties shall be prescribed. Their emolument, if paid otherwise than by fees, to be regulated by the Corporation. 13. The before mentioned officers of the College may obtain leave of absence not exceeding one fortnight from the Principal who shall report the same to the College Council ; but for a longer period only from the Visitors. Htm fi 12 Of the Bursar, REaisTRAR and Librarian. 14. The Bursar shall be appointed and, if need be, removed by the Corporation. 15. It shall be his office to act aa Treasurer of the College, to superintend the College accounts, to inspect and take care of the buildings, and direct small repairs, and report larger ones to the Trustees. He shall account to the Corporation at each annual meeting, up to the commencement of the previous Trinity term, and when so required by the Corporation, at the commencement of each term. His accounts shall also, at all times, be open to the inspection of the College Council. He shall, under the direc- tion of the College Council, have charge of the College grounds, and the superintendence of the improvements thereof 16. The Registrar shall be appointed and removed by the Cor- poration. It shall be his duty to take and preserve the minutes of the meetings, and to have the custody of all deeds and docu- ments of the Corporation, and of the Convocation hereinafter provided for ; such documents, however, being excepted, as belong to the Bursar's department. He shall enrol in the lists of the University, the names of such Candidates as shall produce certifi- cates of having passed the necessary examination ; record all cer- tificates of examination, and all degrees and graces, which shall be granted by the Convocation, and when required, give certifi- cates under the seal of the University of such degrees, or of residence. He shall also prepare all diplomas. 17. A Librarian, and a Curator to the Museum, shall be ap- pointed by the College Council, and act under their direction. VI.— OF CONVOCATION. 1. Of the Chancellor and Vice Chancellor. 1. The office of Chancellor shall always be held for five years, and that of Vice Chancellor for three years. They shall be elected by the Convocation. In case of failure to appoint such Chancellor or Vice Chancellor within three months after any va- cancy of the office, the appointment shall revert to the Corpo- ration. \% la 2. The Chancellor, when present, shall preside a^ all meetings of the Convocation, and in case of an equality, have a casting vote. He shall confer all degrees in the name and on behalf of the University, in such form and after such manner as the Con- vocation shall determine. 3. The Vice Chancellor shall preside and exercise the functions of the Chancellor during his absence, and execute at all other times such duties of hia office as the Chancellor shall delegate to him. 2. Op Membership. 1. The Principal and Professors of the College are ex officio members of Convocation, and ail Masters of Arts, whether by or- dinary or extraordinary graduation, are or shall become members, by an annual payment of four dollars currency to the College or by a single payment of forty dollars. 2. Persons holding rank in any other University of repute may by a vote of the Convocation, be admitted to the same standing and privileges, (" ad eundem ") in the University of Bishop's College, and degrees may bo conferred by vote of Convocation, " honoris causS." 3. Op the Duties and Powers of Convocation. 1. All degrees, whether in the Arts or in the other Faculties of Divinity, Law or Medicine, shall be conferred, and graces and dispensations granted, by vote of Convocation, so far as the grant- ing of the same shall be within its power. No ordinary degree shall be conferred by the Convocation, except upon certificate of satisfactory examination for such degree, unless the Convocation shall see fit to admit at once (per saltnm) to the degree of M.A. students whose examinations for B.A. entitle them to extraordi- nary notice. 2. The Convocation shaU prescribe the subjects and standard of examination for the degree of B. A., and for all other degrees, and also the time and manner thereof, and shall appoint Exami- ners from time to time as may be necessary. It shall meet annu- ally at a set time for conferring ordinary degrees, and meet and llji !l u adjourn, a. it shall see fit, for conferring extraordinary degrees and for other business. It shall also appoint the dresses, and dis- tinguishing insignia of all members of the University and Stu- dents, according to their several degrees and stations. By extraordinary degrees are to bo understood degrees « ad eundem " and " honoris cauaii." 3 Nevertheless it is provided that the Convocation shall enact no law for Itself, nor adopt any custom or order, which shall be con- trary to the Statutes of Incorporation of Bishop's College, the Royal Charter which confers on the said College the powers and privileges of an University, or to these present Statutes, Kules and Ordinances, or such as shall hereafter be passed by the Cor- poration of the said College. VII— OF ADMISSION, RESIDENCE, STUDIES DISCI- PLINE AND GRADUATION. ' I. FACULTY OP ARTS. 1. Admission. a.— Candidates for admission into the University shall present testimonials of good conduct and shall be admitted at such standard of attainment and under such other necessary con- ditions as the Convocation shall define. 6.-They will be required to subscribe to the following declara- tion of obedience to the Rules of the College :— I, A. B., do solemnly promise and declare, that I will, with the assistance of the Divine Grace, during my residence in this Colleo-e faithfully obey the laws thereof, and diligently prosecute all the studies required of me, according to the Rules of the Institution. (Signed,) A. B. c—Iu the case of a Candidate having been a member of any other University, he shall present Testimonids of good conduct from the authorities ; and any number of terms which such Candidate shall have kept, may count as part of the residence required by the regulations. 15 2. Residence and Studies. a.— The ordinary course of Study in the University of Bishop's College shall extend over a space of three years. The sub- jects taught shall consist of Classical and English literature and Composition, History, Mathematics, Natural and Experi- mental Philosophy, Chemistry, Logic, Rhetoric, Moral Phi- losophy and Divinity. 6.— The period allotted to study, in each year, shall be divided into three terms, — Ist. Michaelmas.— From the first Saturday in September, to the twenty-first of December (reckoning inclusively). 2nd. Lent.— From, the third Saturday in January to the first Saturday in April (ditto). 3rd. Trinity.— From the first Saturday in April to the last Wednesday in June (ditto). c, During these terms constant residence will be required of all Students, unless they be prevented by ill health, or be de- tained by urgent business ; in either case, notification and proof must be given to the Principal ; and in the latter, leave of absence obtained from him. No term shall bo counted to any Student as a term of residence, in which he has not been able to reside at least three quarters of the tcx'm. d. — The Principal may dispense with the actual residence in Col- lege of those Students whose parents (or guardians acting as such with the consent and approval of the Principal,) re- side in Lennoxville, or so near the College that the Students may attend the prayers and exercises of the Institution. e._Casual Students, and such as cannot keep continuous resi. dence according to the regulation of the terms, may attend particular courses of instruction, without becoming regular Students, with the approval of the Principal ; such Stud'^nts observing the Rules of the College during their temporary attendance, in so far as these may be applicable to their case. /.—Such Casual Students passing satisfactorily the same exami- nation which is required of regular Students may after a resi- dence of nine terms, be admitted to the degree of B.A. i^ 3. Discipline. a. — Dress. All resident Members of the University and Students shall provide themselves with a decent Gown and Cap accord- ing to the prescribed fashion ; which they shall be expected to wear at Chapel and at Lectures; as also whenever they ap- pear m Public, unless beyond certain limits hereafter to be defined. h.— Attendance on Divine Service. 1. There shall be Morning and Evening Prayers every ordi- nary week day, in the College Chapel-at which all Members of the College shall attend, unless such attendances be dispen- sed with by the Principal. 2. On Sundays, and also on such other days as the Council shall direct, all the Students shall attend Divine Service in the St. George's Church, LennoxviUe, or at the Colle-e Chapel Upon a representation being made by the parents or guar- dians of any Students, that they are not members of the Church of England, their attendance at the above services if desired by such parents and guardians, may be dispensed with, under such regulations as the Principal shall make for their attendance elsewhere. c. — Lectures and Examinations. 1. A list of Lectures for the term, to be sanctioned by the Council, shall be publicly given out by the Professors at the commencement of each term, which Lectures it will be the duty of all Students, belonging to the several classes, to attend. ' ^ 2. There shall be examinations held annually, at such period in Irinity Term as the Council shaU appoint. d — Moral Conduct. I^e moral conduct and discipline of the Students shall be carefully attended to by all the Professors, who shall have power to punish Studente, by imposition, and by confinement to chambers or College grounds-such punishments to be immediately reported to the Principal. 17 4. Expenses. a. — The charge to each Stu lent for tuition, shall be twenty-Revcn dollars, and for room rent anl the use of the College Library, nine dollars ptr an nu?/t, to be paid in the necessary propor- tions each terui. h. — All Students shall be ref^uired to deposit in the Bursar's hands on the first day of each term, the sum of thirty dollars towards the payment of the expenses of the said term ; and shall pay the balance of the term's expenses on whatsoever day shall be duly notified at the end of each term ; and it shall be the duty of the Principal to take care that no Student be received back into the College, or be admitted to a degree without having complied with this regulation. c. — Svery Student before his admission to membership in the University, shall pay into the Bursar's hands the sum of five dollars, which payment shall exempt him from all fur- ther charge whatsoever for registration. But there shall be a charge of one dollar for every diploma granted, and also if any one and the same certificate be required a second time, the Registrar shall be entitled to receive a fee of half a dol- lar: Any person receiving any extraordinary degree shall pay to the Bursar two dollars, (besides the fee for a diploma,) for every such degree, except in cases of degrees " honoris causa." d.- -All fees, (not otherwise specially appropriated,) including those prescribed by the Royal Charter for membership of Convocation shall be placed in a distinct fund, to be applied by vote of Corporation, from time to time, to such general objects as the following, viz. : to provide suitable buildings, furniture, or servants for the use of the University, or to increase the Library, or purchase Philosophical apparatus, or provide a museum, observatory, or the like uses. B I '■ 18 5. Graduation. 1. No Student shall bo allowed to present himself as a can- didate for examination for, or to receive, the degree of, B.A. until he shall have resided nine terms after his admission int.) the University ; but any portion of this residence, not exceeding two terms, may be dispensed with by a special grace of Convocation, if the Student haj been hindered by sickness, or by any other specified urgent cause. 2. The higlier degrees in the Arts and in tlio faculty of Divin- ity and also in those of Law and Medicine-when such faculties shall have been established,-shall bo given after such residence and on such conditions as the Convocation shall hereafter define.' 3. It shall be in the power of Conv.)cation, if they shall so see fit, to appoint exercises for and grant dc.grees in any one sin- gle Art, such as music, as well as generally in the Arts. Never- theless, it is provided that such degrees shall only be given after satisfactory examination. 6. Of the Junior Department. ^ 1. There shall be a Junior Department of the College, in which instruction shall be given with a view to residence in the Univer- sity, and also in such branches of instruction as are usually given in the best Grammar and Commercial Schools. 2 The Kules laid down as above for the Faculty of Arts, shall hold, with such modifications, and such additional or exceptional Kules as tne Council shall define. H.—FAOULTY OF DIVINITY. I. Admission. All Students who are admissible to the degree of B. A are en- titled to become Students of Divinity; and it shall be at the dis- cretion of the Bishops severaUy to admit to studies in this faculty such persons also as they shall see fit who are not graduates of this or any other University. 2. Residence and Studies. All such Theological Students shall attend upon a course of Lectures drawn up under the direction of the Bishops, which shall occupy the space of two years. Id 3. Discipline. 1. Thonlogical Students shall be subject to the general rules of the College, so fai ^a ihey are applicable to their caees, but they shall bo considered to bo moro immediately under the care and superintendence of the Professor of Divinity. 2. They shall hereafter so soon as the circumstances shall admit of such arrangement, bo placed in some building specially ap- propriated to their use, and they shall be subject to any such fur- ther rules and regulations, or be exempted from such of the rules laid down for Students in Arts, as the Bishops shall jointly determine.
