MONTR i: A L: PRINTED BY BROTHER JAMES POTTS, 1845. Y = L A W ARTICLE I. TITLE. This Encampment shall be known and hailed by the name of Hochelaoa Encampment, No. 1, I. O. O. F., of the Province of Canada^ ARTICLE II. SESSIONS. Clause 1. — This Encampment shall hold Regular Sessions on the second and fourth Thursdays of each month. The session held on the second Thursday shall be styled the "Regular Monthly Session", and that on the fourth Thursday the "Regular Adjourned Session". The hour of meeting shall be, from the second Thursday of October to the last Thursday in March, both nights inclusive, at Half-past Seven o'clock, P. M., and from the second Thursday in Arni to the last Thursday in September, both nights inclu- sive, at Eight o'clock. The Encampment shall be opened at the appointed tune. Special Sessions shall be held at the hour designated by the C. P. Clause 2. — The Encampment shall open and close and transact its business in the R. P. D. ; and not less tlian Seven Patriachs of this Encampment shall consti- tute a quorum. The elective and appointed Officers shall attend every Regular and Special Session, unless prevented by sickness or absence from the city. Clause 3. — Every Patriarch shall be clad in the Regalia indicated by rule, charge, or usage, during his presence in the Encampment. Clausk 4. — Regular semi-annual terms, consisting of two Regular Sessions in each month, shall commence on the first Regular Sessions of July and January only, and all terms shall end on the day on which the suc- ceeding one shall commence. ARTICLE III. MEMBERSHIP. Clausr 1.— -Candidates for Membership must be regular Contributmg Members of a Subordinate Lodge, working under the jm-isdiction of the Grand Lodge of Canada. Clause 2.— A proposition for Membership must be submitted in writmg by a Patriarch of this Encamp- ment, and shall state the name of the Brother, his resi- dence, age, occupation, and the Lodge to which he is attached ; the case shall be referred to a Committee of three Patriarchs, two of whom shall be appointed by the C. P. and one by the S. W., who shall report at the next session the result of their investigation. Clausl 4. — Every member on being admitted shall sign the By-Laws of this Encampment, and thereby agree to support the same, and pay all legal demands against him as long as he remains a member. He shall also furnish the Scribe with his residence, and in case of changing or removing it, shall notify the Scribe thereof within four weeks, and in default thereof shall be fined one shiUing and three pence. Clause 5. — Any Patriarch against whom there may be no charge of misconduct, and who is clear of the books, shall, on application to the Encampment, receive a card of withdrawal, by paying the fee for the same, or one for visiting, by paying his dues up to the time to which it is granted. Clause 6. — No Candidate who has been rejected can be again proposed until after the expiration of twelve months. And when a Candidate has been elected, and should not appear in four months to claim the benefit thereof, he shall forfeit the same. ARTICLE IV. DUES AND FEES. Clause 1. — Every Patriarch of this Encampment shall pay one shilling and three pence per month. And he shall pay such tax as may be levied on him for the Funeral Fund. ■■"W. i!. 6 Clal'sk 2. — The Initiation Feu of tliis Encampment shall be £1 5s., which must be paid previous to the Candidate being admitted. Should he be over forty- five years of age he shall pay five shillings in addition for each year attained over forty-five until sixty ; and ten shillings in addition for each year over sixty. The following shall be the rates of Degrees: — The First, or Patriarchal, ten shillings ; for the Second, or G. R., ten shillings ; and for the Third, or R. P. degree, fifteen shillings ; to be paid, in all cases, before confer- ring the degrees, and no degree shall be conferred until the candidate has been ballotted for and elected to receive the same. CxAusE 3. — The fee for depositing the Card of a Patriarch in this Encampment shall be ^1 6s., and should the Patriarch have not received the degrees his application for them shall be disposed of agreeable to Clause 2, Art. IV. Clause 4 — The fee for a Card of Withdrawal from this Encampment shall be one shilling and tlu*ee pence. Clause 5. — A Patriarch shall not be advanced fur- ther than the G. R. degree on the same evening of his initiation, unless the most urgent necessity require it, which shall be decided by a majority of the Patriarchs present. ARTICLE V. OFFICERS. Clause 2. — The appointed Officers shall be a Gu., Ge., 1st W., 2d W., 3d W., 4th W. ; Ist G. of T., 2d G. of T., Ist S. of N., 2d S. of N., who shall serve a regular term each. Section II. — Duties ok Officers. Clause 1. — The C. P. shall preside at all Sessions of the Encampment, and in addition to the powers con- ferred, and duties enjoined ou him by the charges, he may summon extra Sessions at his option, and shall do so, when requested in writing by seven Patriarchs of the Encampment. He shall appoint all subordinate Officers and Committees, not otherwise ordered by law or reso- solutions. He shall sign all orders on the Treasurer which have been passed by the Encampment, and such other documents as require his signature to authenticate them, and pay over the benefits which may be drawn for the sick. He shall enforce the charges and these By-Laws, prevent innovations, and preserve the strict- est decorum. He shall decide all questions of order, subject to the appeal of any two Members to the Encampment, and give the casting vote when there is a tie, except when an appeal has been made from his decision, in which case the question shall be considered lost. He shall superintend all elections or other trans- actions of the Encampment, and never allow the Encampment to be opened unless he is satisfied that none are present but qualified Patriarchs of the Order : and he shall perform such other duties as may be re- quired by law. I Clause 2. — The H. P. shall perform such duties as are enjoined on him by the charjjes and regulations of the Order. Clause 3. — The S. W. shall assist the C. P. in pre- serving order ; and in the absence of that officer shall preside over the Encampment, and shall perform such other duties as are required by the charges and regula- tions of the Order. Clause 4. — The Scribe shall record accurately the proceedings of the Encampment. He shall make out all documents and notices, notify the members of all meetings of the Encampment if required, and perform such other duties as may by law be required of him. Clause 5. — The Financial Scribe shall be elected annually at the Regular Session in June. Ho shall keep the book of accounts with its members, receive all monies and pay the same over immediately to the Treasurer, taking his receipt for the same. He shall, at the close of each term, notify all Patriarchs who arc six months in arrears, and those liable to suspension, and for the faithful performance of all which he shall receive at the rate of two shillings and sixpence per night, payable at the end of each term. Clause 6. — The Treasurer shall receive from the Financial Scribe all monies of the Encampment, giving his receipt for the same ; and shall pay all orders drawn on him by the C. P. and attested by the Scribe, and none others ; and shall give such security for the satisfactory performance of his trust as the Encampment may re- quire; and perform such other duties as may by law be ♦nijoiiiod on him. Section III. — Elections. Claitse 1. — No Patriarch shall be eligible for C. P. or II. P. unless he shall have been elected to and dis- charged the duties of some other elective office ; nor shall any Patriai'ch be eligible to the other elective offices until he shall have been appointed to and have discharged the duties of some appointed office. And all Officers shall be eligible for re-election except the C. P. or H. P., who shall not be, when any qualified Patriarch is in nomination, until one term after passing tho chairs. Clai'se 2. — The Nomination and Election of elective ( )fficers shall take place at the last Regular Monthly Session in each term ; and the Installaticm of Officers shall take place at the first Regular Monthly Session in the succeeding one. Clause 3. — Should there be two or more Candidates for any elective office they shall be ballotted for separ- ately, with written or printed ballots, and must receive a majority of all the legal votes cast to entitle them to an election. No vote shall be considered valid, or recorded as part of th(! poll, unless it be fV>r a regularly nominated Candidate ; and when there are three or more Candidates in nomination, the one having the least number of votes shall be withdrawn at each bal- lot. Should there be but one Candidate in nomination the election shall be by acclamation. ^ f 10 Clause 4. — Any Officer abseating iaimself for more thau three successive Sessions his seat may be declared vacant by a vote of the Encampment ; and all vacan- cies shall be filled in the manner of the former election or appointment, to serve the residue of the term, and the Officer so serving shall be entitled to the full honors of the terra. ARTICLE VI. COMMITTEES. Clause 1. — The C. P. shall appoint, immediately upon his installation, subject to the approbation of the Encampment, the following Standing Committees, viz. : Committees of Finance and Correspondence. Clause 2. — The Committee of Finance shall consist of three members. It shall be their duty to examine into the correctness of all claims against the Encamp- ment, previous to payment ; audit the books of the Financial Scribe ; and to exercise a general supervision over the financial affairs of the Encampment. Clause 3. — The Committee of Correspondence shall consist of three members. It shall be their dutv to take into consideration such communications as shall be referred to them, and report thereon to the En- campment. BENEFITS. Clause 1 Every R. P. D. Patriarch who has been six months a member of this Encampment, and who is not under suspension at the time, shall, if sick, and unable to prosecute his ordinary occupation, be en- titled to and receive £1 per week during his indis- position; provided such sickness or disability does not proceed from intemperance or other immoral conduct. But no Patriarch shall receive benefits for more than three weeks anterior to his being re- ported to the Encampment, absence from the city excepted. Clause 2. — Residence at a distance from this city shall not disqualify a Patriarch from receiving benefits, provided he is not otherwise disqualified. It will be necessary for a Patriarch so circumstanced to send to the C. P. a true statement of his case, certified by a Justice of the Peace, or a repectable Physician, and if it be satisfactory, the benefits shall be forwarded as the Encampment may direct. Clause 3. — In case of the death of a Patriarch, who shall be qualified as provided in Clause 1, there shall be allowed £7 10s. to defray the expenses of his burial, which shall be paid to his nearest relatives, or otherwise disbursed by the C. P., who, in the absence of compe- tent relatives, shall take charge of the funeral ; and the amount shall be refunded by taxing the members 2s. 6d. each, provided there is not »^125 in the fund of the Encampment. 12 Clause 4.— The C. P., H. P., S. W., and J. W., shall constitute a Standing Committee of Visitation and Relief ; to either of whom, in the recess of the Encamp- ment, Patriarchs may be repoi'ted sick ; and it shall be the duty of this Committee to have such services ren- dered as the nature of the case may require ; and the C. P., or, in his absence, the Officer acting for liim, shall pay to the invalid, punctually, the weekly benefit appropriated by law The C. P. shall have a correct roll of the members of the Encampment, for the use of the Visiting Committee, and if circumstances require it, the C. P. shall notify two of the members in rotation, as they stand on the roll, to attend to each sick mem- ber during the night, to administer such assistance as may be in their power ; provided always that the dis- ease be not contagious, infectious, or dangerous to others, of which two respectable p%sicians shall judge. Clause 5 — If a Patriarch in distress shall apply for relief to this Encampment, his application shall be re- ferred to a Committee of three Patriarchs, who shall investigate his circumstances, and report thereon to the Encampment, when, on motion, a sum not exceeding ^1 5s. may be voted for the relief of the applicant, and in no case shall any donation be granted, exceeding that amount, to a Patriarch of another Encampment, if more than two Patriarchs object. ARTICLE VIII. FINES, &c. Ci.Au.SE 2. — Tiie appointed Officers shall be fined Is. 3d., for absence from the Regular Sessions of the Encampment, or from Special Sessions provided they receive notice of the same. CiiAiJSK 3. — The elective and appointed Officers shall be subject to the fines as specified in Clauses 1 and 2, if not present at the Encampment at the calling of the roll, unless prevented by sickness or absence from the city. Clause 4. — Members of Committees other than the Committee of Visitation, failing to attend to the duties of their appointment, shall be fined not less than Is. 3d., unless excused by the Encampment. Members of the Committee of Visitation neglecting their duties shall be fined 5s. for each offence. Clause 5. — Any member of this Encampment, who shall be convicted by the laws of the land of illegal practices, shall be expelled ; and any one who shall be guilty of conduct unworthy of a Patriarch, shall be fined, suspended, or expelled, at the discretion of the Encampment. Clause 6 No Patriarch who is not in regular standing as a member of a Subordinate Lodge, v/ork- ing imder the jurisdiction of the G. L. of Canada, can retain full membership in this Encampment for more than three months from the date of his card of with- drawal from a Subordinate Lodge. Clause 7. — Any Patriarch neglecting or refusing to i;i 14 pay his dues and arrears for six montlis, shall be sus- pended from the benefits for three months after settling the same. And any Patriarch leaving his account unsettled for twelve months, shall, after due notice has been given to him by the Financial Scribe, be suspended from membership during the pleasm*e of the Encamp- ment. C1.AUSE 8. — When a Patriarch who has been sus- pended by this Encampment wishes to be reinstated, his case shall be referred to a Special Committee of three, who, after due investigation, shall report at the next meeting, and should two-thirds of those present voting be in favor thereof, he shall be re-instated. Clause 9 — When a Patriarch has been re-instated he shall pay all arrearages against him at the time of his suspension, and all dues that may have accrued during the time of his suspension. Clause 10. — No member shall be entitled to vote who is one term in arrears, nor upon any question in which he is personally interested. And no member shall be installed into office who k indebted to the Encampment. Clause 11. — It is particularly enjoined upon all, that the members of this Encampment shall treat each other, during its sittings, as well as at all other times, with all due delicacy and respect ; and that all ungenerous re- marks, personal allusions, or sarcastic language, be care- fully avoided, by which the feelings of a Patriarch may be wounded ; or the most prominent of our objects. F. to repress every thing to the contrary. ARTICLE IX. PENALTIES AND TRIAL. Clause 1. — Any Patriarch who shall violate any of the principles of the Order, or offend against these Articles or the By-Laws, shall be subject to be fined, reprimanded, suspended, or expelled, as the By-Laws may direct, ancient usage require, or the Encampment may determine. Clause 2 Every member shall be entitled to a fair trial for any offence involving reprimand, suspension, or expulpiou ; but no member of this Encampment shall be put on trial unless charges duly specifying liis offence be submitted to the Encampment in writing, by one or more Brothers of the Order, except when made liable by non-payment to the Encampment, or when suspended or expelled by the Lodge of which he is a member. Clause 3. — When charges have been preferred against a Patriarch in proper manner, or any matters of grievance between Patriarchs be brought before the Encampment, they shall be referred to a Special Com- mittee of five members, who shall, if possible, be chosen from among the Peers of the implicated Patriarch ; and they shall, with as little delay as the case will admit, summon the parties, and examine and determine the matter in question : and if not involving the expulsion or suspension of a member, or no appeal be taken from their decision to the Encampment, it shall be final, with- out further action from the Encampment. Should the Hi Committeo bo convinced of the necessity of suspending or expelling a member, they shall submit a motion for the purpose to the Encampment for action. Clause 4.-,AVhen a motion for the expulsion or sus- pension of a Patriarch shall have been submitted in due form, it shall be annoimced at the Regular Monthly Session when submitted, and. made the special order of busmess for the next Regular Monthly Session ; and the accused shall be summoned to be in attendance at the Encampment at the time when it may have been determined to consider the question ; at which time, whether the implicated Patriarch be present or not, the Encampment may proceed to consider and deter- mine it; two-thirds of the members present voting in favor of the motion, it shall be carried; and the En- campment shall be fully competent, while such motion IS under consideration, to vary the penalty from the original motion. Clakse 5.— When the decision of a Committee, ap- pomted under Clause 3, for the adjustment of griev- ances, shall not be satisfactory to all parties, either of those interested shall have the privilege of appeal to the Encampment ; and at the time appointed for trying the appeal, the Committee shall present to theEncampt mentin writing, the grounds on which their decision was founded, and the parties shall have the privilege of bemg heard before the Encampment ; and the Encamp, ment shall determine the correctness of the decision of the Committee by a majority of the votes present. Clause 6._Any Patriarch feeling aggrieved by the decision of the Encampment against him, is entitled to an rppeal to the Grand Lodge of the United States for ^^'' suspending. Clause 7. — Any Patriarch having been suspended or expelled, notice thereof .shall be sent to all Encamp- ments in the vicinity : and a Patriarch who has been legally expelled, shall not be again admitted to member- slup, without the consent of the Grand Lodge of the United States. ARTICLE X. FUNERALS. Clause 1. — In case of the death of a Patriarch in good standing, information shall be commxmicated to the C. P., who shall direct the Scribe to call a meeting of the Encampment, to make arrangements for the funeral, and also to notify the Patriarchs severally, to attend the same. Clause 2. — The C. P. shall appoint a Marshal and two Assistant Marshals for the occasion, who shall form and have charge of the procession. Clause 3. — Every Patriarch Avho shall be notified to attend the Funeral of a deceased Patriarch, and fail to appear, shall be subject to a fine of two shillings and six pence, unless necessarily prevented. ARTICLE XI. FUNDS. Clause 1. — No Funds, Stock, or property of any kind;, belonging to this Encampment, shall be disposed of, or transferred in whole or in part^ unless by motion IS at a lieguiar Session, the majority agree to consider the subject at the next lieguiar Monthhf Session ; when if two-thirds concur in the proposition it shall be adopted. Provided, however, that no r lotion to loan the funds shall be entertained. And also provided that this article shall not apply to the passage of bills for con- tingent expenses, nor to the payment of benefits, nor to the special votes of relief of distressed Patriarchs of a sum not exceeding £2 10s. for such relief, when the funds exceed ^50; and £\ 5s. when they do not. except by a unanunous vote of the Patriarchs present of this Encampment. ARTICLE XII. AMENDMENTS, &c. Clausk 1. — A motion to alter, amend, suspend, or annul these By-Laws, or any part of them, shall be submitted in writing, only at a Regular Monthly Ses- sion, and considered at the next Regular Monthlv Ses- sion, and should two-thirds of those present be in favor thereof, the same shall be adopted and have full force as part of these Laws. Clause 2. — This Encampment has power to adopt such rules of order as a majority shall concur in at a Regular Monthly Session, after having been proposed in writing at a previous Regular Session : and to amend, alter or annul the same in like manner. And when a question is before the Encamp- ment, no motion shall be received, unless to adjourn — to lie on the table — the previous question — to postpone — to refer — or to amend ; and shall have precedence in the order in which they are arranged, the first three of which shall be decided without debate, 3. — A motion to adjourn shall be in order after initiation and conferring degrees. 4 When a blank is to be filled, the question shall be first taken on the highest sum or number, and on the longest time proposed. 5. — Any member may call for the division of a ques- tion when the sense will admit of it. 6. — Five members calling for the yeas and nays, they shall be ordered by the C.
