Whosoever forges or fraudulently alters any document bearing or purporting to bear the signature of the Governor of Canada. ^ 40 of any deputy of the Governor, or of the Lieutenant-Governor of the Provinces of Ontario, Quebec, Nova Scotia and New Bru of any person, who, at any time, administered the Government the Provinces now constituting Canada, or offers, utters, disp^ puts off, ahy such forged or fraudulently altered document as 46 knowing the same to be so forged or altered, is guilty of felony, be liable to be imprisoned in the Penitentiary for life or for any 14 less than two years, or to be impruoned in any other gaol or place of con- finement for any term less than two years, with or without hard labour, and with or without solitary confinement. 3. Whosoever forges or alters, or in any way publishes, puts off or utters as true, knowing the same to be forged or altered, any copy of 5 letters patent, or of the enrolment or enregistration of letters patent, or of any certificate thereof made or given, or purporting to be made or given by virtue of any Statute of Canada, of any one of the late Pro- vinces of Upper Canada, Lower Canada, or Canada, or of the Provinces of Ontario, Quebec, Nova Scotia or New Brunswick, is guilty of felony, 10 and shall bo liable to be imprisoned in the Penitentiary for any term not more than seven years, nor less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour. 4. Whosoever forges or counterfeits or alters, any public register or ^^ book, appointed by Taw to be mad% or kept, or any entry therein, or wilfully certifies or utters any writing as and for a true copy of such public register or book, or of any entry therein, knowing suph writing to be counterfeit or false, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary tor any term not more than fourtef ^ years, nor less than two years, or in any other gaol or place of confine- ment for any term less than two years, with or without hard labour, and with or without solitary confinement. Whosoever forges, or alters, or offers, utters, disposes of, or puts off, knowing the same to be forged or altered, any note or bill of ex- change of any body corporate, company or person carrying on the business of bankers, commonly called a Dank note, a bank bill of ex- change, or a bank post bill, or any endorsement on or assignment of 20 any bank note, bank bill of exchange, or bank post bill, with intent to defraud, is guilty of felony, and shiul be liable to be imprisoned in the Penitentiary for life, or for any term not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labor, and with or without 25 solitary confinement. 16. Whosoever, without lawful authority or excuse (the proof whereof shall lie on the party accused), purchases or receives from any other person, or has in his custody or possession any forged bank note, bank bill of exchange, or bank post bill, or blank bank note, blank 80 bank bill of exchange, or blank bank post bill, knowing the same to be forged, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary for any term not exceeding fourteen years and not less than two years, or to be imprisoned in any other gaol or place of con- finement for any term less than two years, with or without hard labor. 85 As to making paper and engraving plates, ^c, for bank n»tes, ^e. 17. Whosoever, without lawful authority or excuse (the proof whereof shall lie on the party accused), makes or uses, or knowingly has in his custody or possession, any frame, mould or instrument for the making of paper used for Dominion or Provincial notes,or for Bank-notes with any words used in such notes, or any part of such words intended to resemble 10 or pass for the same, visible in the substance of the paper, or for the making of paper with curved or waving bar lines, or with the laying wire lines thereof in a waving or curved shape, or with any number, sum or amount expressed in a word or words in letters, visible in the substance of the paper, or with any device or distinction peculiar to and appearing 45 in the substance of the paper used for such notes, respectively, or makes, uses, sells, exposes to sale, utters or disposes of, or knowingly has in his custody or possession any paper whatsoever with any words used in such notes, or any part of such words, intended to resemble 14^ and pass for the samo, vi&iblo in tho substance of the paper, or any paper with curved or waving bar lines, or with the laying wire lines thereof in a waving or curved shape, or with any number, sum, or amount expressed m a word or words in letters, appearing visible in 5 the substance of tho paper, or with any dovico or distinction peculiar to and appearing in tho substance of tho paper used for any such notes respectively, or by any art or contrivance causes any such words or any part of such words, intended to rcsomblo and pass for tho same, or any device or distinction peculiar to and appearing in the substance 10 of the paper used for any such notes, respectively, to appear visible in tho substance of any paper, or causes tho numerical sum or amount of any such note, in a word or words in letters to appear visible in tho substance of the paper, whereon tho same is written or printed, is guilty of felony, and shall be liable to bo imprisoned in the Penitentiary for 15 any term not exceeding fourteen years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour. 18. Nothing in the last preceding section contained shall prevent any person from issuing any bill of exchange or promissory note having 20 the amount thereof expressed in a numerical figure or figures denoting the amount thereof in pounds or dollars, appearing visible in the sub- stance of tho paper upon whicli the same is written or printed, nor shall prevent any person from making, using or selling any paper having waving or curved lines, or any other devices in the nature of water- 25 marks visible in tho substance of the paper, not being bar lines or laying wire lines, provided tho sumo are not so contrived as to form tho groundwork or texture of tho paper, or to resemble the waving or curved laying wire lines, or bar lines, or the water-marks of the paper used for Dominion Notes or Provincial Notes or Bank Notes, as 80 aforesaid. 10. Whosoever, without lawful authority or excuse (the proof where- of shall lie on tho party accused), engraves, or in anywise makes upon any plate whatsoever, or upon any wood, stone, or other material, any promissory note, or part of a promissory note, purporting to be a 35 Dominion or Provincial Note or Bank Note, or to be a blank Dominion or Provincial Note or Bank Note, or to be a part of any Dominion or Provincial Note or Bank Note as aforesaid, or any name, word or character, resembling, or apparently intended to resemble, any sub- soription to any such Dominion or Provincial Note or Bank Note, as 40 aforesaid, or use any such plate, wood, stone or other material, or any other instrument or device for tho making or printing of any such note, . or part of such note, or knowingly has in his custody or possession any Buoh plate,^wood, stone, or other material, or any such instrument or device, or .knowingly offers, utters, disposes of, or puts off, or has in his 45 custody or possession any paper upon which any blank Dominion or Provincial Note or Bank Note, or part of any such note, or any namu, word or character resembling, or apparently intended to resemble, any such subscription, is made or printed, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary for any term not exceeding 50 fourteen years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary confinement. 90. Whosoever, with intent to defraud, forges «t alters, or offers, utters, disposes of, or puts off, knowing the same to be forged or altered, any will, testament, codicil, or testamentary instrument, is guilty of 30 felony, and shall be liable to be imprisoned in the Penitentiary for life or for any term not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary confinement. 99. Whosoever forges or alters, or offers, utters, disposes of, or puts 85 off, knowing the same to be forged or altered, any bill of exchange, or any acceptance, indorsement or assignment of any bill of exchange, or any promissory note for the payment of money, or any indorsement on or assignment of any such promissory note, with intent to defraud, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary 40 for life or for any term not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary confinement. 96. Whosoever, with intent to defraud, draws, ma^es, signs, ac- cepts or indorses, any bill of exchange or promissory note, or any un- 10 dertaking, warrant, order, authority, or request for the payment oi money, or for the delivery or transfer of goods or chattels, or of any bill, note, or other security for money, by procuration or otherwise, for, in the name, or on the account of any other person, without lawful authority or excuse, or offers, utters, disposes of, or puts oif. any such 15 bill, note, undertaking, warrant, order, authority, or request, so drawn, made, signed, accepted, or indorsed by procuration or otherwise, with- out lawful authority or excuse, as aforesaid, knowing the same to have been so drawn, made, signed, accepted, or indorsed as aforesaid, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary 20 for any term not exceeding fourteen years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard la|)our, and with or without solitary confinement. 98. Whenever any cheque or draft on any banker is crossed with 25 the name of a banker, or with two transverse lines with the words "and company," or any abbreviation thereof, whosoever obliterates, adds to, or alters any such crossing, or offers, utters, disposes of, or puts off, any cheque or draft whereon any such obliteration, addition, or alter- ation has been made, knowing the same to have been made, with intent SO in any of the cases aforesaid to defraud, is guilty of felony, and shiU be liable to be imprisoned in the Penitentiary u)r life or for any term not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary confinement. 85 99. Whosoever fraudulently forges, or alters, or offers, utters, dis- poses of, or puts off, knowing the s?.me to be forged or fraudulently al- tered, any debenture issued under any lawful authority whatsoever, either within Her Majesty's dominions, or elsewhere, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary for any term 19 not exceeding fourteen years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary confinement. Aa to forging private marks, ^c. SO. Whosoever vends any goods, wares or merchandise, having thereon any forged or counterfeited private or trade mark, token, stamp or label, purporting to be the private mark, token, stamp or label of any other peraun, knowing the same at the time of the sale thereof by him, 5 to be forged or counterfeited, is guilty of a misdemeanor, and shall be liable to be imprisoned in any Common Gaol or place of confinement other than a Penitentiary for any term not exceeding six months, or to a fine of not more than one hundred dollars or both, in the discre- tion of the Court. 10 39. Whosoever knowingly forges, or utters, knowing the same to be forged, any ticket or order for a free or paid passage on any Railway or on any Steam or other Vessel, with intent to defraud, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary for a term not exceeding three years nor less than two years, or to be 15 imprisoned in any common gaol or place of confinement other than a Penitentiary for any term less than two years. Aa to forging records, process, instruments of evidtnce, ^e. 33. Whosoever forges or fraudulently alters or offers, utters, dis- poses of, or puts off, knowing the same to be forged or fraudulently altered, any record, writ, return, panel, process, rule, order, warrant, 20 interrogatory, deposition, afiidavit, affirmation, recognizance, cognovit actionem, or warrant of attorney, or any original document whatsoever, of or belonging to any Court of Record, or any bill, petition, process, notice, rule, answer, pleading, interrogatory, deposition, affidavit, affiir-r mation, report, order, or decree, or any original document whatsoever 25 of or belonging to any Court of Equity or Court of Admiralty, or any original document whatsoever of or belonging to any Court of Justice, or any document or writing, or any copy of any document or writing used or intended to be used as evidence in any Court in this section mentioned, , is guilty of felony, and shall be liable to be imprisoned in the Peniten- 30 tiary for any term not exceeding seven years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with. or without hard labour, and with or without solitary confinement. 34. Whosoever, being the clerk of any Court, or other officer hav< 35 ing the custody of the records of any Court, or being the deputy of any such clerk or officer, utters any false copy or certificate of any record, knowing the same to be false; and whosoever, other ihan such clerk, officer or deputy, signs or certifies any copy or certificate of any record as such clerk, officer or deputy ; and whosoever forges or fraudulently 40 alters, or offers, utters, disposes of or puts off, knowmg the same to be- forged or fraudulently altered, any copy or certificate of any record, or offers, utters, disposes of or puts off, any copy or certificate of any record having thereon any false or forged name, hand-writing or signa- ture, knowing the same to be false or forged ; and whosoever forges iS the BttA of any Court of Record, or forges or fraudulently alters any process of any Court whatsoever, or serves or enforces any forged process of any Court whatsoever,knowing the same to be forged,or delivers orcauses to be delivered to any person any paper, falsely purporting to be any such process, or a copy thereof, or to be any judgment, decree or order 50 of any Court of law or equity, or a copy thereof, knowing the same to be false, or aets or professes to act uuaer any such false process, know- ing the same to be fals«^ is guilty of fsiony, and sh«ll be liable, to b«. 14-11. i imprisoned in the Penitentiary for any term not exceeding seven years and not less than two years, or to be imprisoned in any other gaol or Elaoe of confinement for any term less than two years, with or withont ard labour, and with or without solitary confinement. 35. Whosoever forges or fraudulently alters or offers, utters, dis- 6 poses of or puts off, knowing the same to be forged or fraudulently altered, any instrument, whether written or printed, or partly written and partly printed, which is or shall be made evidence by any Act passed by the Legislature of any one of the late Provinces of Upper Canada, Lower Canada or Canada, or passed or to be passed by the 10 Parliament of Canada or by the Legislature of any one of the Provinces of Ontario, Quebec, Nova Scotia or New Brunswick, and for which offence no other punishment is herein provided, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary for any term not exceeding seven years nor less than two years, or to be imprisoned in 15 any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary con- finement. 36. Whenever any such instrument has been admitted in evidence, the Court or the Judge or person who has admitted the same, may at 20 the request of any party against whom the same has been admitted in evidence, direct that the same shall be impounded and be kept iu custody of some Officer of the Court or other proper person, for such period, and subject to such conditions as to the Jourt, Judge or person admitting the same, may seem meet. 25 A$ to forging notarial aet9, regitttn of deech, ^o. 87. Whosoever forges or fraudulently alters, or offers, utters, disposes of or pate off, knowing the same to be forced or fraudulently altered, any notarial act or instrument, or copy,purporting to be an authenticated copy thereof, or any proee$ verbal of a surveyor, or like copy thereof, or forges, or fraudulently alters, or offers, or utters, disposes of puts off, 30 knowing the same to be forged or fraudulently altered, any duplie ate of any instrument, or any memorial, affidavit, affirmation, entry, certi- ficate, indorsement, document, or writing, made or issued under the provisions of any Act heretofore passed by the Legislature of any one of the late Provinces of Upper Canada, Lower Canada or Canada, or 85 £assed or he^'eafter to be passed by the Parliament of Canada, or by the legislature of any one of the Provinces of Ontario, Quebec, Nova Scotia, or New Brunswick, for or relating to the registry of deeds, or other instruments or documents respecting or concerning the title to or claims upon any real or personal property whatever, or forges, or counterfeits 40 the seal of or belonging to any office for the registry of deeds, or other instruments as aforesaid, or any stamp or impression of any such seal; or forges any name, hand writug or signature, purporting to be the name, hand-writing or signature of any person to any such memorial, affidavit, affirmation, entry, certificate, indorsement, document, or 45 writing, required or directed to be signed by or by virtae of any Act, passed, or to be passed, or offers, utters, disposes of, or puts off, any such memorial or other writing as in this section before mentioned, having thereon any such forged stamp or impression of any such seal, or any such forged name, hand-writing or signature, knowing the same 50 to be fo.rged, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary, for any term not exceeding fourteen yean and not less 14-13. -*j£iri-j?at^ijiij-;Ai ""■"P" nffi«9 mm wm ^IHI than two ye&rs, or to be imprisoned in any otiier gaol or place of con- finement for any term less than two years, with or without hard labour, and with or without solitary confinement. As to forging orders, ^e., of Justices of the Peace. 38. Whosoever, with intent to defraud, forges or alters, or offers, 5 utters, disposes of or puts off, knowing the same to be forged or altered, any summons, conviction, order or warrant, of any Justice of the Peace, or any recognizance purporting to have been entered into be- fore any Justice of the Peace or other officer authorized to take the same, or any examinatinn, deposition, afiidavit, nffirmation or solemn 10 declaration, taken or made before any Justice of the Peace, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary for any term not exceeding three years nor less than two years, or to bo imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without 15 solitary confinement. As to forging the names of Judges, ^o. 30. Whosoever, with intent to defraud, forges or alters any certifi- cate, report, entry, indorsement, declaration of trust, note, direction, authority, instrument or writing made or purporting or appearing to be made by any Judge, officer or clerk, of any Court in Canada, or the 20 name, hand-writing or signature of any such Judge, officer or clerk, as aforesaid, or offers, utters, disposes of, or puts off any such certificate, report', entry, indorsement, declaration of trust, note, direction, au- thority, instrument or writing, knowing the same to be forged or altered, is guilty of felony »nd shall be liable to be imprisoned in tho Peniten- 25 tiary for any term uot exceeding fourteen years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary confinement. As to falsely acknowledging recognizances, ^c. 40. Whosoever, without lawful authority or excuse (the proof where- 80 of shall lie on the party accused), in the name of any other person ac- knowledges any recognizance of bail, or any cognovit actionem, or judgment, or any deed or other instrument, before any Court, Judge, Notary, or other person lawfully authorized in that behalf, is guilty of felony, and shall be liable to be imprisoned in the Penitentiary for any 85 term not exceeding seven years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without soli- tary confinement. As to forging marriage licenses, 41. Aa to forging registers of biiihs, marriaget, and deaths. 49. Whosoever unlawfully destroys, defaces or injures, or causes or permits to be destroyed, defaced or injured, any register of births, bap- tisms, marriages, deaths or burials, which now is or hereafter shall be 5 by l:iw authorized or required to be kept in Oannda or in any one of the provinces of Ontario, Quebec, Nova Scotia or New Brunswick, or any part cf any such register, or any certified copy of any such reciiter, or of any part thereof, or forges or fraudulently alters in any such regist«r any entry relating to any birth, baptism, marriage, death or burial, or 10 any part of any such register, or any certified copy of such register, or of any part thereof, or knowingly and unlawfully inserts, or causes or permits to be inserted in any such register, or in any certified copy thereof, any false entry of any matter relating to any birth, baptism, marriage, death or burial, or knowingly and unlawfully gives any false 15 certificate relating to any birth, baptism, marriage, death or burial, or certifies any writing to be a copy cr extract from any such register, knowing such writing, or the part of such register whereof such copy or extract is so given, to be false in any material -particular, or forges or counterfeits the seal of or belonging to any register office or burial 20 board, or offers, utters, disposes of, \".^>t 7 shall be deemed an incompetent witness, in support of the proseontion by reason of any interest which such person may have ov be supposed to have in respect of any deed, writing, instrument or other matter given in evidence on the trial of such indictmont or information ; but the evidence of any person or persons so interested or supposed to" be ^ interested shall in no case be deemed sufficient to sustain a conviction for any of the said offences unless the same is corroborated by other legal evidence in support of such prosecution. SS. Whosoever, after the commencement cf this Act, is convict- ed of any offence which has been subjected by any Act or ^cts 10 to the same pains or penalties as are imposed by the Act passed in the fifth year of the Reign of Queen Elizabeth, intituled *'An Act against formers of false deeds and writiugs," for any of the offences first enumerated in the said Act, is guiltT of felony, and shall, in lieu of such pains and penalties, be liable to be imprisoned in the Penitentiary 15 for any term not exceeding fourteen years and not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less than two years, with or without hard labour, and with or without solitary confinement. 416. Where by any Act now in force in any Province of Canada' 20 any person falsely making, forging, counterfeiting, erasing, or altering any matter whatsoever, or uttering, publishing, offering, disposing of, putting away, or making use of any matter whatsoever, knowing the same to have been falsely made, forged, counterfeited, erased, or altered, or any person demanding, or endeavoring to receive or have 25 anything, or to do or to cause to be done any act, upon or by virtue of any matter whatsoever, Knowing such matter to have been falsely made, forged, counterfeited, erased, or altered ; or where by any such Act now in force any person falsely personating another, or falsely acknow- ledging anything in the name of another, or falsely representing any 30 other person than the real party to be such real party, or wilfully making a false entry in any book, account or document, or in any manner wilfully falsifying any part of any book, account, or document, or wilfully making a transfer of any stock, annuity or fund in the name of any person not being the owner thereof, or knowingly taking any 35 false oath, or knowingly making any false affidavit or false affirma- tion, or demanding or receiving any money or other thing by virtue of any probate or letters of administration, knowing the will on which such probate shall have been obtained to have been false or forged, or knowing such probate or letters of administration to have been obtained iO by means of any false oath or false affirmation ; or where by any such Act now in force any person making or using or knowingly having in his custody or possession any frame, mould or instrument for the mak- ing of paper, with certain words Tisible in the substance thereof, or any person making such paper, or causing certain words to appear visible in 45 the substance of any paper, would, according to the provisions contained in any such Act, be guilty of felony and be liable to any greater pun- ishment than is provided by this Act, then and in each of the several oases aforesaid, if any person after the commencement of this Act is con- victed of any such felony as is hereinbefore in this section mentioned, or 50 of aiding, abetting, counselling, or procuring the commission thereof, and the same is not punishable under any of the other prorisions of this Act, evei^ such person shall be liable to be imprisoned in the Peni- tentiary for life or for any term not less than two years, or to be imprisoned in any other gaol or place of confinement for any term less 55 44'18 / than two years, with or without hard labour, and with or witliout solitary confinement. 110 S7, Every accessory after tho fact to any felony punishable under this Act, shall be liable to be imprisoned in any gaol ^ or place of confinement, other than tho Penitentiary, for any term less than two years, with or without hard labour, and with or without solitary confinement; and every person who aids, abets, counselsor procures the commission of any misdcmoanorpunishableunder this Act, shall be liable to be proceeded against, indicted and punished, jQ as a principal offender. Id 20 SS. Whenever any person ia convicted of a misdemeanor under this Act, the Court may, if it thinks fit, in addition to or in lien of any of the punishments by this Act authorized, fine the offender, and require him to enter into his own recognizances, and to find sure- ]^5 ties, both or either, for keeping the peace and being of good behaviour ; and in all cases of felonies in this Act mentioned, the Court may, if it thinks fit. require the offender to enter into his own recogni- zances, and to find sureties, both or either, for keeping the peace, in addition to any of the punishments by this Act authorized ; provideid 2^y that no person shall be imprisoned under this section for not finding sureties, for any period exceeding one year. 25 SO.
