Be it enacted by the Governor, Council and AssemMy, That the present Board of Trustees, that is to say, Donald Keith, William H. Neal, James Kerr, William A. Hesson, John A. Sinclair, Murdoch M. Lindsay and Donald G. Keith, and their respective successors in office, to be elected annually as herein- after mentioned, shall be and are hereby declared the Trustees of the said Church, and shall be, and are hereby declared to be, a Body Politic and Corporate in deed and in name, and shall have succession forever by the name of "The Trustees of St. Matthew's Church in Halifax ; " and by that name shall and may sue and be sued, implead and be impleaded, answer and be answered unto, and prefer and prosecute any bill or bills of indictment or information whatsoever, in anj' Court or Courts or places whatsoever in this Province ; and shall have full power and capacity to purchase, receive, take, have, hold, possess and enjoy for the use and benefit of said Church, as well goods and chattels ttmrnm (I as lands, tenements and hereditaments, and improve and use the same for the benefit of the said Chrrch according to their best discretion, and the true intent and meaning of the Donors by whom the same shall or may be given, devised or bequeathed to the use and benefit of said Church ; and shall also have full power and authority by and with the assent of the Congre- gation at a meeting to be duly convened for that purpose, from time to time in their corporate capacity to sell, mortgage or lease any lands, tenements or hereditaments, now or hereafter to be held by them for the benefit of the Congregation of such Church, and to execute and deliver all deeds or other instru- ments necessary for such purpose. 2. Annually on the third Monday in January, or on such other day in that month as the Trustees and Elders shall jointly appoint, at a Congregational Meet- ing to be duly convened seven peraons who are mem- bers or adherents of said Church shall be elected as such Trustees by such persons and in such manner as the rules and regulations of the Church shall from time to time prescribe. 3. At the Annual or other Congregational Meeting to be duly convened, the Congregation shall have power to make, and from time to time to alter, revoke and make anew such rules and regulations as they shall think fit, for the calling and hdding of meetings for defining the qualification of voters and the conduct of business at such meetings, for the appointment and payment of officers, for the disposition and manage- ment of the property of the Church both real and personal, for the allotment of pews, for the recovery, ■7 '^'■^Wi disposal and application of all moneys and funds of the said Church, the leasing, mortgaging and disposal of the goods, chattels, lands, tenements and heredita- ments, or any of them, or any part thereof, belonging to the said Congregation, and which may from time to time be held by the said Trustees hereby incor- porated for the use and benefit of the said Church, for the selecting and supporting of the Ministers of such Church and regulating the contract with such Minis- ters, and generally for the good order and care and conduct of the said Congregation, its affairs and busine.vs as to the said Congregation may seem meet and proper. 4. All those lots and parcels of land situate on the east side of Pleasant Street, in Halifax aforesaid, whereon the Church of St. Matthew's and the Manse belonging thereto are now erected, with all the appur- tenances thereof, are hereby declared to be vested in the said Trustees, their successors and assigns, to and for the use of the said Congregation ; and the said Trustees shall be entitled to receive and recover all rents and moneys due to or for the said congregation. 5. All Acts and parts of Acts inconsistent with this Act are hereby repealed. nMmm EULES AND REGULATIONS OF THE CONGHEGATION OF ST. MAHHEW'S CHURCH, IN HALIFAX, Made and Passed at a General Meeting of said Oongregation^ held in the Oburch, on Monday, the I4th of Jttne, 1880. I. All Meetings of the Congregation shall be opened ■with prayer. II. At all Meetings of the Congregation dulj^ convened, all registered contributors towards the funds of the Church, consisting of heads of families, male and female, and all others of the age of 21 years and upwards, having been adherents and contributors for at least two years preceding, shall have the right to vote on all matters submitted to such meetings. III. At the Annual Meeting of the Congregation, seven adherents who have been refjistered contributors to the support of ordinances for three years immediately preceding, shall be elected Trustees by ballot. Four at least of the old Trustees shall be re-elected. m.' Mfa t 9 <*' V. The Trustees shall meet at least once a month on such a day as they shall determine. Three shall con- stitute a quorum. At the first meeting after their election they shall appoint from their number a Chairman and Vice- Chairman, and also from the Congregation a Secretary and Treasurer. V. The Trustees shall have the management of the temporal affairs of the Congregation, including the care of the property, collection of all contributions for the support of ordinances, the payment of the Minister's stipend, salaries of church officers, and shall regulate and administer all matters committed to their charge by these rules; and shall also observe any special directions which may from time to time be given them by the Congregation, they shall also audit the Treasurers account and report upon the same at every Annual Meeting. VI. The Session or Trustees are empowered to call a meeting of the Congregation whenever they shall judge it necessary, or any Congregational Meeting shall be called upon a requisition to that effect in writing, directed to the Session or Trustees, and duly signed by at least twenty qualified voters. VII. Notice of ail meetings of the Congregation shall be given from the pulpit and by written or printed notices '*'*'*';v \ ^•^ mklmmm»ittil f^^^ I 10 near the Church door, on the Sunday immediately preceding such meeting ; or by printed notices sent to each voter, or left in their pews or sittings on the Sunday forenoon immediately preceding such meeting. VIII. At all meetings called by the Session, the Minister of the Congregation shall preside, and the Session Clerk shall act as Secretary. At all other meetings a Chairman shall be appointed by those present, and the Secretary of the Trustees shall act as the Secretary of the meeting. IX. At all meetings of the Congregation at least fifteen qualified voters shall be present before proceeding to business. X. All persons holding pews by purchase, either in whole or part, and having been duly registered as such pewholders, shall continue to hold the same, but any such pewholder failing to contribute to the sup- port of the Congregation for one year, shall thereby forfeit all right to such pew or portion thereof as the case may be, and the same shall revert to the Trustees and be disposed of in the way prescribed for pews not held by registered owners. The allotment of pews shall be entirely in the hands of the Trustees. Allotments to be made only at their regular meetings. Application for pew accommodation to be made in writing, stating the number of sittings required. Such application to be addressed to the Chairman of '—Vi Mtai ■M 11 Trustees, or the Secretary of the Congregation, and placed before the Trustees in the order received at their first regular meeting. XI. No person will be permitted to make any alteration in his pew or sittings except such as the Trustees may assent to. No cushion to be stuffed with wool or any material that will harbour moths, and all are to be covered with material of the same color as the lining of the pews. XII. When a pewowner with his family removes from the City of Halifax, and is absent for one year and ceases to contribute to the funds of the Church, his right to the pew shall revert to the Congregation and the Trustees may^ allot the same to any applicant. XIII. The Trustees shall appoint a sexton whose duty it shall be to open and shut the doors of the Church, to see 4hat it is kept clean and in good order ; to deliver notices and to attend to such other duties connected with the Church as may be necessary under the direc- tion of the Trustees and Kirk Session. XIV. All sums collected in the Church for charitable purposes, for the Church library, for Sabbath School support, for the purchase of Sacramental elements or any other purpose connected with the spiritual edifi- W.W "T'-T" ,.s, ^:..^ WirtlMlill^M 12 cation of the people shall be under the control of the Session, as well as all monies specially placed in their hands, «ind shall be accounted for annually to the Congregation. XV. The appointment of an organist and such other officers not enumerated, shall be vested jointly in the Session and Trustees. XVI. The foregoing Rules and Regulations shall not be altered or abridged without the consent of at least three-fifths of the legal voters of those present at any meeting called for such purpose.
